Guardianship Legal Services

Facilitate mandatory certificate of medical examination and psychological assessments to support guardianship applications.

Evaluate need and explain the purpose of guardianship for the person and/or for the estate of an incapacitated person.

Prepare application for guardianship; request proper service and notices; obtain ad litem appointment; guide applicant through JBCC certification and necessary background checks.

Represent clients in court proceedings to establish guardianship; present evidence of the level of need for proposed ward, including less restrictive alternatives; provide proposed orders; support qualification of newly-appointed guardians with their bond application, and obtain Letters of Guardianship.

Assist guardians with required annual reports of the Guardian of the Person and/or of the Estate, to renew Letters each year.

While court-ordered reversal of a guardianship is extremely rare, the disability or death of the guardian can trigger a termination, and then, a new guardianship proceeding to find a replacement. DJS can also request modifications of existing guardianship, for example, if the ward's condition deteriorates, the guardian's authority needs to expand to fully protect the ward.
